In a radio interview last Wednesday with right-wing talk show host Scott Hennen, Vice President Dick Cheney said something frightening:
So the question now before us is: Did the vice president deliberately issue an ambiguous endorsement of waterboarding, or was this a slip-up? Anyone familiar with his history would have to say the former. Vice President Cheney almost certainly expected--and now relishes--this criticism from civil libertarians, because he believes that it will send the message that Republicans are concerned about the lives of Americans rather than the civil liberties of accused terrorists. After all, his administration has spent the past five years trying to convince us all--with some success--that the two concerns are mutually exclusive.

Again, this debate seems a little silly given the threat we face, would you agree?In this excerpt, Cheney does seem to endorse a torture technique known as waterboarding--simulated drowning in which the person being interrogated gets "a dunk in water"--and implies that the Bush administration has used it in the past. President Bush had already implicitly conceded in a September 6th speech that his administration had used techniques in the past that some would regard as torture, but waterboarding--sometimes called water torture, or the water cure--is one of the oldest, most common, and most widely condemned forms of torture. As Human Rights Watch explains:
THE VICE PRESIDENT: I do agree. And I think the terrorist threat, for example, with respect to our ability to interrogate high value detainees like Khalid Sheikh Mohammed, that's been a very important tool that we've had to be able to secure the nation. Khalid Sheikh Mohammed provided us with enormously valuable information about how many there are, about how they plan, what their training processes are and so forth, we've learned a lot. We need to be able to continue that.
The Congress recently voted on this question of military commissions and our authority to continue the interrogation program. It passed both Houses, fortunately. The President signed it into law, but the fact is 177 Democrats in the House -- or excuse me, 162 Democrats in the House voted against it, and 32 out of 44 senators -- Democratic senators voted against it. We wouldn't have that authority today if they were in charge. That's a very important issue in this campaign.
Are we going to allow the executive branch to have the authority granted and authorized by the Congress to be able to continue to collect the intelligence we need to defend the nation.
Q Would you agree a dunk in water is a no-brainer if it can save lives?
THE VICE PRESIDENT: It's a no-brainer for me, but for a while there, I was criticized as being the Vice President "for torture." We don't torture. That's not what we're involved in. We live up to our obligations in international treaties that we're party to and so forth. But the fact is, you can have a fairly robust interrogation program without torture, and we need to be able to do that.
And thanks to the leadership of the President now, and the action of the Congress, we have that authority, and we are able to continue to program.
Waterboarding dates at least to the Spanish Inquisition, when it was known as the tormenta de toca. It has been used by some of the most cruel dictatorships in modern times, including the Khmer Rouge in Cambodia. In some versions of the technique, prisoners are strapped to a board, their faces covered with cloth or cellophane, and water is poured over their mouths to stimulate drowning; in others, they are dunked head-first into water.The Military Commissions Act certainly should ban waterboarding, but it's not at all clear to me that it does in certain instances thanks to the new, looser anti-torture language. (More on this in a few days.) Regardless, one would have to consider Vice President Cheney an idiot to believe that he didn't know what Hennen meant by "a dunk in water." Nobody has accused the administration of running dunk-a-mujahadeen booths at the county fair. The issue is waterboarding--nonlethal partial drowning as an interrogation technique--and while he might now claim that he didn't mean to endorse it, the vice president has not proposed a plausible alternative explanation for what he said.
The United States has long considered waterboarding to be torture and a war crime. As early as 1901, a U.S. court martial sentenced Major Edwin Glenn to 10 years of hard labor for subjecting a suspected insurgent in the Philippines to the “water cure.” After World War II, U.S. military commissions successfully prosecuted as war criminals several Japanese soldiers who subjected American prisoners to waterboarding ...
The U.S. Congress recently adopted the Military Commissions Act ... Two of the chief sponsors of the legislation, Senators John McCain and John Warner, have said that it criminalizes waterboarding.

Tom, I agree that Cheney knew what he was doing. He was with a *friendly* reporter, for goodness sakes!
That said, I think that if he did this for the reasons you cite in your last graph … that he (and Rove, if this was planned) miscalculated. They are on the *defensive* big time and off-message, right before the election.
